Terms of service
These terms are written to be read. They say what you are buying, what we owe you, what you owe us, and what happens when either of us wants to stop. Where the site makes a promise — the 14-day refund, pausing with banked days, cancelling without notice, owning the work — this document is the contract behind it.
Who we are and what this covers
“Recast”, “we” and “us” mean Recast UX, a design studio established in Amman, Jordan. “You” means the company or person who creates an account at recastux.com or signs an order with us, and anyone you invite to that account.
These terms cover the subscription service (the plans), the five-day pilot sprint, and any front-end build work we quote separately. Enterprise engagements are governed by a master services agreement (MSA) that takes precedence over these terms where the two differ.
Definitions
- Plan — one of the self-serve subscription tiers listed at /pricing: Starter, Growth, Scale. Each plan states how many streams it includes.
- Stream — one request in progress. A plan with two streams means two requests are worked at the same time; the rest wait in your queue.
- Request — a unit of work you file on your board: a screen, a flow, part of a design system, a page, a build task. You may file as many as you like.
- Deliverables — what we hand over for a request: Figma files, tokens, specs, prototypes, recordings, written notes, and where applicable source code.
- Working day — Sunday to Thursday, excluding public holidays in Jordan, which we publish in your dashboard at the start of each year.
- Pilot — the five-working-day engagement described at /pilot, priced at $490.
The service: streams and requests
We provide an embedded product design team on a monthly or annual subscription. You file requests; we work them one stream at a time, in the order you set, with a senior designer working each request and a design lead reviewing it before it reaches you. Revisions on the active request are unlimited: we revise until you tell us it is done, or until the request is archived.
“Unlimited requests” means there is no cap on how many you file. It does not mean they are all worked at once; the plan decides how many run in parallel. We say this on the pricing page and we say it here so that there is no argument about it in week one.
We assign a named designer and a named design lead at kickoff. We may change either at our discretion to maintain quality or availability; if you ask us to change your designer, we will, at no cost and without requiring a reason.
Accounts, seats and access
You need an account to use the service. You are responsible for the accuracy of the details you give us, for keeping your login secure, and for everything done under your account by people you have invited. Every plan includes unlimited seats for your team; each invited person accepts these terms by using the account.
You must be at least 18 and, if you are accepting on behalf of a company, authorised to bind it. We may suspend an account that is used to breach these terms, after telling you why, and we will restore it once the breach is resolved.
Plans, billing and payment
Prices are in US dollars, exclusive of VAT or sales tax where applicable, and are those shown at /pricing on the day you subscribe. Monthly plans are charged in advance on the day you subscribe and on the same day each month. Annual plans are charged in advance for twelve months at the annual rate, which is equivalent to ten months at the monthly price.
Card and PayPal payments are processed by PayPal (PayPal Pte. Ltd. or the PayPal entity for your region). We do not store card numbers. Enterprise customers may pay by bank transfer or invoice on the terms in their MSA; invoices are due within 30 days and may be issued in USD, SAR or AED.
If a payment fails, we retry it and notify you. If it has not succeeded within seven days your account moves to “past due” and work on your streams pauses until payment is made; nothing is deleted, and the days lost are not banked. We do not charge late fees on self-serve plans.
You may upgrade at any time; the difference is charged pro rata for the rest of the current period and the new price applies from the next one. You may downgrade at any time; the new price applies from the next period.
Starter is the lowest tier we offer. We do not sell a tier below $1,999 a month and we do not offer discounts beyond the annual rate.
The 14-day refund
On every self-serve plan, if within fourteen days of your first payment you decide the service is not working for you, tell us and we refund that payment in full. One confirmation in your billing settings, or one email, is enough. We will not ask you to take a call, complete a survey or accept an alternative offer first. You keep every deliverable we have produced up to the refund, and we keep our right to show that work only as described in the ownership section below.
Pausing and banked days
You may pause your subscription at any time from your billing settings. When you pause, the unused days remaining in the current paid period are banked. While paused you are not charged and we do not work your streams; your files, board and history stay exactly as they were. When you resume, the banked days are applied in full before the next charge. Banked days have no cash value, cannot be transferred and are not refundable, but they do not expire while your account exists.
Cancelling
You may cancel at any time from your billing settings, in one action, with no notice period and no cancellation fee. Service continues to the end of the period you have paid for and nothing further is charged. Outside the 14-day window there is no pro-rata refund of the remaining period; if you would rather keep the days, pause instead. You keep everything delivered.
We may end your subscription if you materially breach these terms and do not remedy the breach within 14 days of our notice, or immediately if the breach cannot be remedied. If we end the subscription for any other reason we refund the unused part of the current period.
Turnaround, revisions and working days
First-concept windows (48 hours on Starter, 24–48 hours on Growth, same or next business day on Scale) are measured in working days from the moment a request has enough information to start. They are targets we hold ourselves to and report on in your dashboard, not guarantees; a missed window does not in itself entitle you to a refund, but a pattern of missed windows is exactly the situation the 14-day refund and the no-notice cancellation exist for.
We work Sunday to Thursday on Amman time. Requests filed on Friday or Saturday are treated as filed on Sunday. Public holidays in Jordan are published in your dashboard. If we are unable to work for more than five consecutive working days for reasons within our control, we bank those days for you automatically.
Ownership of the work
On delivery of each version of a deliverable, and provided the fees for the period in which it was delivered have been paid, we assign to you all intellectual property rights in that deliverable. This applies whether you stay a month or a year, and it survives cancellation. Where an assignment is not possible under applicable law, we grant you a perpetual, worldwide, royalty-free, exclusive licence instead.
We do not assign, and you receive a non-exclusive licence to use as part of the deliverables:
- our pre-existing materials, tools, templates, methods and know-how;
- third-party materials — fonts, icon sets, libraries, stock assets — which remain subject to their own licences, and which we identify in the handoff so you can confirm your own licence where one is needed;
- open-source code, which remains under its own licence.
Unless you have selected white-label delivery, signed an NDA with us, or asked us in writing not to, we may show the work in our portfolio and in conversations with prospective clients after it has been publicly released by you. We will never publish anything you have not released, and we remove any item from our portfolio within five working days of your request.
Your content and brand assets
You keep all rights in the material you give us — briefs, brand assets, product access, data, screenshots, copy. You grant us a licence to use it only to provide the service. You confirm you have the right to give it to us, and that it does not infringe anyone else's rights. We use your production systems only where you have given us access for a request, and only as far as the request needs.
Confidentiality and white-label
Each of us keeps the other's non-public information confidential, uses it only for the purposes of the service, and shares it only with people who need it and are bound by equivalent obligations. This lasts for three years after the subscription ends, and indefinitely for trade secrets. Our standard NDA is available on request and is included as standard on Enterprise.
If you select white-label delivery on Growth, we deliver in per-client folders under your brand, our name does not appear on deliverables or in communications intended for your client, and we will not contact your client. You remain responsible to your client; we remain responsible to you.
Acceptable use
You may not use the service to produce material that is unlawful, that infringes third-party rights, that is designed to deceive users of your product into harm, or that would bring either of us into disrepute. We may decline a request on those grounds and will tell you why. You may not resell access to the service except as white-label delivery to your own clients on the terms above.
Warranties and limits of liability
We warrant that the service is provided with reasonable skill and care by suitably qualified people, and that deliverables are our original work or properly licensed. We do not warrant that a design will achieve any particular commercial result, or that third-party platforms (Figma, Webflow, Framer, app stores) will behave in any particular way.
Neither of us is liable to the other for indirect or consequential loss, loss of profit, revenue or data, however arising. Our total liability to you under these terms in any twelve-month period is limited to the fees you paid us in the three months before the event giving rise to the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.
Data and subprocessors
How we handle personal data is set out in our privacy policy, including the list of subprocessors — Google Cloud and Firebase, Vercel, PayPal, Resend, PostHog, Cal.com and Slack — and where data is stored. Where you give us personal data belonging to your users (for example, in research recordings), you are the controller and we act on your instructions; a data processing addendum is available on request and is included as standard on Enterprise.
Governing law and disputes
These terms are governed by the laws of the Hashemite Kingdom of Jordan. The courts of Amman have exclusive jurisdiction, except that either of us may seek an injunction in any court to protect intellectual property or confidential information. Before starting proceedings, we each agree to try to resolve the dispute in a conversation between people with authority to settle it, within 30 days of one side asking. Enterprise customers may agree different governing law and venue in their MSA.
These terms are written in English. An Arabic version is available on request; if there is a conflict, the English version prevails.
Changes to these terms
We may update these terms. If a change reduces your rights or increases your obligations, we give you at least 30 days' notice by email and in your dashboard, and you may cancel before it takes effect without the change applying to you. Other changes take effect when published, with the date at the top of this page updated.
